SUBJECT: Guidelines in accordance with article 13 of the legislative decree of 30 June 2003 No. 196

GENERAL CONSIDERATIONS

1.  The above-mentioned legislative decree regulates the confidentiality of personal data and imposes a series of obligations on those who “handle” information referring to third parties. Among the requirements to be fulfilled is that of:

a)   informing the person to whom the data refer on the use that is made of the specific information,

b)   to obtain consent to carry out the specific activities.

2.  The law in question intends “handling” of the data to mean the following activities:

collection, recording, organisation, storing, processing, amending, selection, extraction, comparison, use, interconnection, blocking, cancellation, destruction.

ULTIMATE PURPOSE AND METHOD OF HANDLING

3.  In relation to the data contained in the Curriculum Vitae supplied by you when logging on to our website and in observing the aforementioned provisions we inform you that

a)      the personal data that will be requested of you and that you will communicate on the web are necessary for you to receive the newsletter containing all the news, institutional and commercial initiatives concerning INTERPORTO CAMPANO S.p.A., and to use the services provided by the portal of INTERPORTO CAMPANO S.p.A. and that you have requested;

b)  the personal data in question will be stored on magnetic and paper support by persons authorised to carry out these functions, who are constantly identified, suitably trained and made aware of the limitations imposed by L. D. 196/03, applying security measures suitable to guarantee the privacy of the interested party to whom the data refer, avoiding wrongful access by third parties or unauthorised personnel;

c)  the data will be safeguarded - using the appropriate security procedures - also in the event of technical maintenance and support to the IT devices and related processing procedures.

FIELD OF DISTRIBUTION

4.  The handling of data with the ultimate purposes set out in section a) of paragraph 3 shall also include the communication, and in some cases distribution of the data in possession to third parties, such as:

firms or public and/or private companies of any kind or sector,
companies managing the Nascar S.r.l. portal, in Italy and abroad (E.E.C. and non-E.E.C.).

NATURE OF THE CONFERRAL OF DATA

5.  Personal data - as can easily be understood - are indispensable to send the newsletter and provide the services of the website. They are optional and therefore the refusal to provide such information, and the failure to give consent to the performance of the handling phases in point 2 of this document which become necessary from time to time, make it impossible to send the newsletter and to use of the services of the portal.
INDICATION OF THE OWNER OF DATA HANDLING PROCEDURES

6. The handling of data by the firm consists in the identification, within the meaning L. D. 196/03 of a number of subjects with specific duties and responsibilities. In this case the owner of the data handling is INTERPORTO CAMPANO Spa; – Via Paolo Emilio Imbriani 30 - 80132 NAPLES and the person responsible is MR. Giuseppe Raimo, manager of the firm.

7. To allow you full awareness of the problem, annexed to the present document is a copy of the text of article 7 of L.D. 196/03 concerning your rights regarding the handling of data.

article 7 – The right of access to personal data and other rights.

1. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet recorded, and their communication in intelligible form.
2. The interested party has the right to obtain details of:
a) the origin of the personal data;
b) the ultimate purpose and method of handling;
c) the logic applied in the event of handling carried out with the aid of electronic instruments;
d) the identifying details of the owner, the persons responsible and the designated representatives in accordance with Art. 5, paragraph 2;
e) the persons or categories of persons to whom personal data can be communicated or which can be made known as designated representative on the national territory, persons responsible or engaged therein.
3. The interested party has the right to obtain:
a) an update, the rectification or, when necessary, the integration of the data;
b) the cancellation, the transformation in an anonymous form or the blocking of data handled in violation of the law, including those it is not necessary to keep with regard to the purpose for which the data has been gathered or successively handled;
c) certification that the operations mentioned in letters a) and b) have been made known, also in terms of their subject matter, to those to whom the data have been communicated or distributed, except in the case where this is impossible or would mean the use of means manifestly disproportionate to the right being protected.
4. The interested party has the right to oppose, wholly or in part:
a) the handling of his personal data for legitimate reasons, even though pertinent to the aim of the data collection;
b) and the handling of personal data concerning him for the purpose of dispatching publicity material or direct sales or to carry out market research or business communication.
